Consumer Terms and Conditions

1. About Us

  1. Who we are. Boisdale Ltd (we and us) is a company registered in England and Wales under company number 2703434. Our registered office is at 15 Eccleston Street, London, SW1W 9LX.
  2. Our registered VAT number is 563 0825 46.

Please read these terms and conditions carefully before placing an order with us. By placing an order, you agree to be bound by these terms and conditions.

2. The Contract Between Us

  1. By placing an order through the Website, you warrant that:
    1. You are legally capable of entering into binding contracts; and
    2. You are at least 18 years old (see section 3: Age Restrictions).
  2. The contract between us. Our acceptance of your order will occur when we process your payment and send you an order confirmation email, at which point a contract between you and us will come into existence (the Contract). If you place an order on a Saturday, Sunday, or UK bank holiday, your order will be processed and confirmed on the next working day.

3. Age Restrictions

  1. It is illegal for any person under the age of 18 to buy, or attempt to buy, alcohol, or for anyone over 18 to purchase alcohol for someone under 18. By placing an order, you confirm that both you and the recipient are at least 18 years old.
  2. We may operate an age verification policy at delivery/collection. You may be asked to provide identification. If our couriers are uncertain of the recipient’s age, they will request ID and will not leave alcohol if satisfactory proof is not provided.

4. Order Process

  1. You may order products via the Website.
  2. You may review and amend your order at any time until it is placed.

5. Prices

  1. All prices are displayed on our Website and include VAT (where applicable) at the prevailing UK rate.
  2. Prices may change from time to time, but they will not affect any order you have already placed.
  3. We reserve the right to adjust prices, offers, products and specifications at any time before accepting your order.
  4. We aim to ensure prices are correct when entered on our system. See section 5.6 for pricing errors.
  5. Delivery charges are not included in product prices and will be shown during checkout. Total cost will be displayed on the checkout page.
  6. If we discover a pricing error with products you have ordered, we will contact you to offer the choice of continuing with the correct price or cancelling your order. We are not obliged to supply products at an incorrect price.

6. Our Products

  1. Images on our Website are for illustrative purposes. Colours shown may vary depending on your device.
  2. We may amend products to comply with legal or regulatory requirements.
  3. Measurements are approximate, and packaging may vary.

7. How to Pay

  1. Payment methods include PayPal, American Express, Mastercard, Visa, Apple Pay and Google Pay.
  2. Refunds for returned products will be processed within 14 days of receipt.
  3. Payment is required in advance. We will take payment when dispatching your order.
  4. If we are unable to take payment, your order will be suspended until payment is made.

8. Returns and Your Right to Cancel

  1. You may cancel your Contract within 14 days of receiving products and receive a full refund under the Consumer Contracts Regulations 2013.
  2. If you receive the products before cancelling, you must return them within 14 days of cancellation.
  3. Deductions may be made if products have been used, damaged, or the packaging opened.
  4. Refunds will be made within 14 days of us receiving returned products.
  5. You cannot cancel if products are bespoke or inseparably mixed with other items after delivery.

9. Cancellation by Us

  1. We may cancel the Contract if:
    1. We have insufficient stock (and you have not opted for substitutions);
    2. We do not deliver to your area; or
    3. A pricing error has occurred.
  2. If we cancel, we will inform you by email and refund any payment within 30 days. No additional compensation will be due.

10. Delivery

  1. Products will be delivered to the address specified on your customer account or provided at checkout.
  2. Estimated delivery timeframes are shown for each product, but are not guaranteed.
  3. Delivery may be attempted up to three times before products are returned. You may then be required to arrange redelivery at your expense.
  4. Risk in the products passes to you upon delivery.
  5. An authorised person aged 18 or over must sign for delivery.
  6. Delivery to neighbours or safe places may not be available for age-restricted products.
  7. We deliver to mainland UK only (not Channel Islands, Jersey, or PO Boxes).

11. Product Availability and Substitutions

  1. If a product is unavailable, we will offer a replacement or a refund, at your choice.

12. Your Responsibility to Inspect Products

If products are damaged or defective, you should reject them on delivery. If a defect is discovered later, we will replace or refund you.

13. Our Liability

  1. If products are not as ordered, damaged, or incorrectly delivered, you are entitled to a refund or replacement within 30 days.
  2. We are not liable for damage caused after delivery.
  3. Delivery timeframes are estimated only. If delivery is not made within 30 days, you must notify us within 40 days of ordering.
  4. Our obligation is to make good any shortfall, replace defective products, or refund you.
  5. You agree not to use products for commercial purposes. We are not liable for indirect or consequential loss.

We do not exclude liability for:

  1. death or personal injury caused by our negligence;
  2. fraud or fraudulent misrepresentation;
  3. breach of legal rights under the Sale of Goods Act 1979 or Consumer Rights Act 2015; or
  4. defective products under the Consumer Protection Act 1987.

14. Notices

All notices to us must be sent in writing to info@boisdale.co.uk. Notices from us to you will be displayed on our Website.

15. Events Beyond Our Control

We are not liable for delays or failure to deliver products due to events beyond our reasonable control.

16. Invalid Terms

If any part of these terms is found to be unenforceable, the remaining terms will continue to apply.

17. How We Use Your Personal Information

  1. We will collect and process your personal data to supply products under our Privacy and Cookie Policy.
  2. By creating an account and/or placing an order, you agree to be bound by our Privacy and Cookie Policy.

18. Third-Party Rights

Nothing in this Contract confers any rights on any third party.

19. Governing Law

These terms are governed by English law, and disputes may be brought in the courts of England and Wales.

20. Complaints and Contacting Us

  1. If you have a complaint, contact info@boisdale.co.uk with full details, including your order number. Complaints are acknowledged within 2 working days, and we aim to resolve them within a further 72 working hours.

21. These Terms and Conditions

  1. These terms (along with our Terms of Use, Privacy Notice, and Cookies Policy) apply to all consumer orders placed via this Website, telephone, or email.
  2. Nothing in these terms affects your statutory rights. Advice is available from Citizens Advice or Trading Standards.
  3. We may update these terms without notice concerning future sales. Updated terms take effect from publication, so please check them before ordering.
